Here at Consilia legal we have been campaigning to change the current archaic law on divorce and bring it in line with modern day living. We are pleased to announce that Justice Secretary, David Gauke has now announced plans to introduce the ‘no fault’ divorce and this will remove the need for couples to allege ‘fault’ at the start of the divorce within their divorce petition.
Historically, blame was apportioned to parties in divorce proceedings which resulted in court battles to decide who is to be the Petitioner in the proceedings before even looking at financial matters. This resulted in contested acrimonious divorces, something which the courts and legal professionals today try to avoid, with the use of alternative dispute resolution methods such as mediation.
