You do not need to hire a lawyer to represent you in Court. In most cases, representation will be determined on the issue of affordability.  Legal costs significantly increase when the case progresses through the Court system. The longer the case goes on, the higher the fees incurred. When there are limited assets in a case, it is not always cost proportionate for parties to spend a significant proportion of those assets on solicitors and Court costs.  Proportionality is one of the key considerations the Court will take into account in financial remedy proceedings.

Some parties require support during the Court process and feel they have no alternative but to have representation. That being said, they should not be deterred from acting in person because the Magistrates and /or the District Judge will ensure proper procedure is followed and will make certain they are not prejudiced in any way.

Some parties are confident enough to address the issues to the District Judge or Magistrates themselves.  They know the facts of the case inside out and see no point instructing a solicitor because they can do it themselves.  For those individuals, they are encouraged to seek independent legal advice throughout the case so they are aware of their legal rights.

Are There Disadvantages to Having Legal Representation?

There are disadvantages for a represented party in court proceedings when the other is without representation. The represented party is met with higher costs due to the other party not understanding the legal process, making inaccurate applications or simply being unable to prepare bundles and mandatory documents for the Court.  In those circumstances, the burden falls onto the represented party to carry out this important work leading to higher costs. Often, parties become frustrated and feel this is extremely unfair but as lawyers, we must follow the rules.
